|2023 KCSE Remarking Cases Dismissed by Court. Last year’s Kenya Certificate of Primary Education (KCPE) candidates, hopeful for their answer sheets to be re-evaluated, faced disappointment as the High Court dismissed their aspirations.
The complaint, targeting the Kenya National Examination Council (KNEC) and Education Cabinet Secretary Ezekiel Machogu, was brought forth by parents of students from Moi Primary School Kabarak-Nakuru.
Despite acknowledging “massive flaws in the examination results,” Justice Lawrence Mugambi ruled against the parents and their children, noting their failure to first challenge the results with KNEC as required by law.
According to Justice Mugambi, the Kenya National Examination Council Act mandates candidates to seek a review of their results from KNEC before seeking recourse elsewhere, such as the National Examinations Appeals Tribunal.
Moreover, Moses Mbego initiated a lawsuit against KNEC and the Education Cabinet Secretary, expressing shock at his child’s lower grades compared to their usual exceptional performance.
Similarly, parents of Class Eight candidates at Kitengela International School and Set Greenhill Academy Mixed Day, Boarding, and Junior School resorted to legal action, citing significant irregularities.
Their lawyer, Danstan Omari, voiced concerns over discrepancies between students’ previous performance and their KCPE results, alleging that the examination process jeopardized the future of Kenyan children.
Omari highlighted anomalies in the marking process and called for judicial intervention to address the grievances raised by teachers, students, and the public.
Furthermore, Omari argued for the suspension of the form-one placement exercise until the case was resolved, emphasizing the widespread irregularities observed in the 2023 KCPE exam results.
