List of TSC Interdiction Offences

Teachers employed by the Teachers Service Commission (TSC) are bound by the teachers code of conduct that was enacted by the commission in 2012.

In TSC code of conduct, there are offences that the commission considers are tantamount to interdiction once the teacher is found guilty.

In case the teacher contravenes the set regulations, the commission’s act stipulated necessary disciplinary action that will be taken against the teacher.

Bodies Charged with Teacher Interdiction

  • TSC CEO

The commission’s CEO is mandated with interdiction of the teacher if the investigation is launched by the TSC head office. Upon the teacher being proven guilty, the teacher is interdicted but can appeal if not agreeing with the decision and outcomes of the case.

  • TSC Sub-County Directors

TSC Sub-County Directors are also mandated to execute interdiction of teachers. But their powers are limited to interdiction of primary school teachers.

  • Deputy County Directors

This group is only mandated to interdict primary school heads. They can also interdict high school teachers where there is no active Board of Management.

  • TSC County Directors

The commission has installed county directors in all the 47 counties. They act on behalf of the Teachers Service Commission as agents.

This group is only limited to interdiction of secondary school teachers.

  • School Board of Management

The school Board of Management where the Principal is the secretary acts as a representative of TSC. The board has powers to interdict a teacher at the investigation stage if the teacher is found guilty of the offense charged.

List of Offences that Attract Interdiction

A teacher can not be interdicted before prior investigation is conducted to obtain a proof concerning the offence committed. Once the teacher is found culpable of the offense, the teacher can now be interdicted but has a chance to appeal the decision.

The offences that can lead to teacher Interdiction include;

  1. Canal knowledge (CK)/ Penal Knowledg.
  2. Negligence of Duty
  3. Absenteeism
  4. Desertion of Duty
  5. Insubordination
  6. Misappropriation of school funds
  7. Teacher Convicted of criminal offence

Once the teachers been fully interdicted by the commission, the teacher will be deregistered/struck out of the commission’s register

If the teacher appeals and it turns out that the teacher was Interdicted wrongly, he/she will be Reinstated and all the salary arrears compensated to him.
